
You may recall yesterday when a developer edition of Google Glass showed up on eBay and started generating bids approaching the $100,000 mark. We suggested the listing may end up getting pulled at Google's request since the devices are not supposed to be sold or otherwise given away by the developers who have managed to get a pair. It looks like we were right as the auction was canceled yesterday. The appearance and subsequent cancellation of the device on eBay triggered some folks to take a look at the terms and conditions related to owning Google Glass. In there, for the Explorer Edition you will find the following language:
Unless otherwise authorized by Google, you may only purchase one Device, and you may not resell, loan, transfer, or give your Device to any other person. If you resell, loan, transfer, or give your device to any other person without Google’s authorization, Google reserves the right to deactivate the Device, and neither you nor the unauthorized person using the Device will be entitled to any refund, product support, or product warranty.
It looks like only those beta testers who received the devices are allowed to own them unless they can somehow obtain authorization from Google for a transfer. Interestingly, the normal terms as currently drafted for Google Glass indicate:
You may not commercially resell any Device, but you may give the Device as a gift…
I'm not sure whether “commercially resell” would apply to an eBay auction when the normal Google Glass devices show up. It does look like Google is hoping to keep a pretty tight lid on Glass devices when they do hit the market. The question then is how they are going to do that?

I’m suprised that in the last couple days that one hasn’t been bricked yet, and that there’s not been physical teardown done yet. It would be amazing to know what’s inside one of those. Whatever website gets that first is going to get a lot of traffic…
