Netherlands judge rules Samsung Galaxy S, S II violate Apple patents 4

A Hague judge has just issued a ruling in Apple's infringement case against Samsung.

The ruling prohibits “the marketing of Samsung smartphones Galaxy S, S II and Ace for violation of Apple Inc. EP 2,058,868”.  The court explains in an official press release that the Hague judge ruled to “ban trading of Samsung smartphones Galaxy S, S II and Ace” but also added that Samsung did not violate Apple patents with its Galaxy Tab 10.1 and 10.1v.  The Judge determined that Samsung violated patent 2,058,868 which deals with “method of scrolling”.  Samsung was found not to have infringed on patent 2,098,948 that covers “recording a flag in connection with multiple screen taps”, or patent 1,964,022 which relates to dragging a slider to unlock the phone.  It hasn't been confirmed but from an online translation it appears the ban will take effect on October 13th.

Today's ruling is in response to Apple's request to the Dutch court to stop Samsung from selling all Galaxy branded phones and tablets in Europe. For those keeping track at home, the hearing was held one day earlier than expected.  After originally being scheduled for September 15th, the hearing was then re-schedule for August 25th.  It appears the Dutch court did one better and heard the case today.

Update:  It has been pointed out by a Dutch IP attorney that the judge has ruled patent 1,964,922 to be null and void, meaning Apple can no longer make claims based on this patent in the Netherlands.  In addition, the judge also found that Samsung did not infringe on patent 2,098,948.  The infringement of patent 2,058,868 does not affect the Galaxy Tab 10.1.

Update 2 – According to various sources, Samsung has stated that the company will replace the software the court ruled an infringement, mainly its gallery app, allowing Sammy to continue to sell the popular device abroad.

  1. How much money did apple waste –it must be nice having more than the government by the way — in an effort to block the sale of a superior product-ya know, instead of putting that money toward making something that can actually compete? This is insane…

  2. I didn´t understant it properly.
    So, basically, the Judge said Sammy infriged one patent and Sammy will correct it so they can continue to sell Galaxy S, S2 and Ace again?
    Is that it????
