Actually, ROMs are completely legal. They simply use an honor system that says you can only download ROMs of games you already own. I have never heard of ownership of the game ever being validated though.

Emulators and their roms are only illegal if you dont own the actual game, so they arent illegal themselves...people just never use them legally
