New document in Apple, Samsung trial show Samsung’s use of iPhone as standard

As a week of courtroom drama drew to a close in the Apple v. Samsung patent case, a new document surfaced showing how Samsung used Apple’s features as a measuring stick for their own development. The document was an internal analysis comparing the Samsung Behold 3 (also known as the Vibrant) to the iPhone. Some of the features that Samsung identified included things like a bouncing visual effect, the slide to unlock feature, and even the transition time when entering passwords.

It remains to be seen whether the jury will see this as an attempt to copy the iPhone’s features or as identification of capabiities and features that could be improved upon or done in a different manner.

    See this is such a one sided fight. Apple taking Samsung to court, everything here is going Apple’s direction because a lot of mistakes on Samsung’s part early on in the trial and leaking out information that shouldn’t have. What I see happening here though is, Apple and Samsung going back to court again after this one, this time I see it going the other way around. Because it does seem like the court is on Apple’s side with how they’ve shot them down even on any form of evidence they tried to bring up.

    It feels like that the courts have decided that this is Apple’s time to present itself and does not want to hear from Samsung at all and shuts them down every chance they get. This is purely speculation based on all of the reading I’ve done here and on other sites. Pretty much Apple is the only one allowed to claim Copy Infringement. When the proof ( Before it was leaked ) was quite evident that Samsung had a lot of these designs long before any iPhone came about. Note how Apple focuses on only the devices that Samsung put out AFTER the iPhone….

    I don’t like a one sided fist fight. But I also know that if Samsung loses, I can almost promise they’ll be the ones initiating the next lawsuit and will have a slightly different outcome. Because they did screw this one up a bit by not dotting their ‘i’s and crossing their ‘t’s in this case. They should have never leaked anything out and kept themselves under better control in the courtroom. I hope they can bounce back, it’s not too late yet.

    I think Koh is providing ample grounds to appeal and move the venue to a court outside California. It’s obvious the deck is stacked in California.

      I can’t agree more, I don’t think it should have ever been held in California, considering that to me will prove to be more Apple territory than any other.

    I dont see how this can be seen as against Samsung. As a businessman I tend to look at what my competition is doing inorder to out do it. And comparing my product to the industry leader at the time is not such a big thing. I am sure Apple looked up to some other phones before iphone releases. I mean we all know that the notification system of IOS has been taken from android so will that be considered a copy?

      The problem here is the same problem Apple had back in the 80′s when they were claiming a lot of stuff was stolen from them by Microsoft and IBM. If anyone knew computer history, they’d know that Apple from day one has copied IBM and Xerox from the start. They claimed to of had the first PC, nope! Xerox did. But you’ll never hear this from the Apple users.

      Ever since then, anything that anyone else does, steals from Apple’s ideas and so on…. They are the biggest pile of hypocrites that walk this planet at the moment and this court battle is being held in a place where I can pretty much promise is going to lean Apple. I wish I could be the fly on the wall in that courtroom, but I don’t live in California.

      They’re far worse now than they were back in the 80′s, because they’ve lost so much market share in sales of mobile devices due to Samsung and Android. Funny thing is, it’s Samsung now? Who do they go after next? The Patent system needs an overhaul, plain and simple, needs fixed….

          Well I hate to tell you but I in computers from start of 1979 all the way to present day. I’ve used every kind of computer ( Macs included ) and know a hell of a lot more than you probably would like to find out I know.

          I’m not some snot-nosed child on a website spouting off nonsense because I can. I’m just finally getting tired of the Apple Mentality that plagues this world. I’ve dealt with it my entire life and I’m quite sick of it. As a graphic artist I’ve had to deal with more of it than most people would care to.

          So go ahead, post your links or don’t bother trying to be the next latest and greatest know it all on the block. At least I have a history to back up my knowledge other than the internet….
